Our client’s home was in foreclosure for about 3 years prior to coming to us for help. After completing the debt analyst there was no way the client could be approved for a modification. They just had too much debt. We recommended that the client consult a bankruptcy attorney. The client filed a bankruptcy; Once the BK was filed, we immediately submitted all necessary documents for the modification review. During that time, the lender filed for and received a relief of stay from the court.
In June of 2012, the trustee company auctioned off the client’s home. We contested the SALE and continued to work with the lender to reverse the illegal SALE. During that time, the trustee claimed they did not receive the necessary documents from the lender to stop the SALE. So the property was sold to an investor who immediately took a title on the property. However, we stayed focus on the lender, never backing down. After lots of hard work, the illegal SALE/foreclosure was resinded in January 2013; we made sure that documents were filed with the county recording office. After the home was returned to the homeowner, we were able to put the client into review for a modification. Now in April 2013, Bank of America offered the client an affordable trial period payment of $1,952 from an unaffordable payment of 3,259.
